UH, JUST AS A BRIEF BACKGROUND, ACCESSORY DWELLING UNITS, AS THE COUNCIL IS AWARE, ARE INDEPENDENT SECONDARY DWELLING UNITS LOCATED ON THE SAME PROPERTY AS AN EXISTING PRIMARY OR PROPO OR EXISTING OR PROPOSED PRIMARY DWELLING UNIT.
UH, THERE'S A COUPLE DIFFERENT FORMS. THEY TAKE THE TRADITIONAL A DU, UH, A JUNIOR, A DU, WHICH IS A SMALLER VERSION THAT HAS TO BE LOCATED ENTIRELY WITHIN THE EXISTING HOME OR WITHIN AN ATTACHED GARAGE.
AND AN EFFICIENCY A DU, WHICH YOU CAN THINK OF MORE AS LIKE A STUDIO APARTMENT.
UH, THE CITY FIRST ADOPTED ITS A DU REGULATIONS IN 2017, WHICH AT THE TIME REPLACED OUR SECOND DWELLING UNIT OR GRANNY FLAT ORDINANCE AS SOME PEOPLE MAY RECALL IT BEING CALLED.
AND THEN WE DID A SIGNIFICANT UPDATE IN 2021 WHEN THE STATE STARTED ROLLING OUT A LOT OF ITS, UH, MANDATORY STATUTES AND REQUIREMENTS FOR CITIES.
AND THEN JUST THIS LAST YEAR WE ALSO REVISITED IT TO ELIMINATE A RESTRICTIVE COVENANT REQUIREMENT FOR ADUS, WHICH HAD BECOME, UH, BURDENSOME AND UNNECESSARY.
SO AS WITH MANY THINGS, THE REASON THAT WE'RE, UH, REVISITING IT AGAIN HERE TODAY IS CHANGES IN STATE LAW.
UH, SENATE BILL NUMBER 4 77 REORGANIZED THE STATE'S A DU PROVISIONS IS PROBABLY ONE OF THE FEW A DU LAWS THAT I TRULY APPRECIATE 'CAUSE IT MAKES IT A LOT EASIER TO FOLLOW.
UH, ASSEMBLY BILL NUMBER 25 33 PROVIDE AN INCREASED OPPORTUNITY TO LEGALIZE ON PERMITTED ADU 3 57, EXPANDED THE SE QL EXEMPTION TO INCLUDE ORDINANCES ADDRESSING J ADUS.
AND LASTLY, ONE OF THE BIGGER ONES WAS SENATE BILL 1211, WHICH INCREASED THE PERMISSIBLE NUMBER OF ADUS FOR MULTIFAMILY DEVELOPMENT PROJECTS, AS WELL AS PROHIBITED LOCAL AGENCIES FROM REQUIRING PLACEMENT OF UNCOVERED PARKING AND LIMIT FURTHER LIMITED SOME OF THE THINGS THAT WE CAN ASK FOR IN A DU PROJECTS.
SO THE PROPOSED UPDATES THAT ARE BEFORE YOU THIS EVENING MAINLY MODIFICATIONS TO COMPLY WITH STATE LAW AS WELL AS A FEW THINGS THAT WE THINK WILL PROVIDE SOME CLARITY IN OUR EXISTING REGULATIONS AND WILL HELP TO, UH, ADDRESS SOME OF THE, THE ITEMS THAT HAVE COME UP DURING OUR EXPERIENCE OVER THE LAST FEW YEARS, PERMITTING AND REVIEWING THESE TYPES OF PROJECTS.
UH, THE FIRST IS THAT WE'RE GONNA INCREASE MAXIMUM HEIGHT FROM 16 FEET TO 18 FEET, UH, AND ALLOW ATTACHED ADUS TO MATCH THE HEIGHT OF THE PRIMARY DWELLING.
WE'RE GONNA CLARIFY THE STANDARDS APPLICABLE TO A DETACHED TWO STORY.
A DU, UH, REQUIRE INTERIOR ENTRY FOR JDS THAT SHARE A BATHROOM WITH THE EXISTING PRIMARY AND THEN CLARIFY AND UPDATE OBJECTIVE DESIGN STANDARDS THAT APPLY TO MOST OF OUR A DU PROJECTS.
IN RESPONSE TO SE SENATE BILL 1211, WE WILL UPDATE OUR CODE TO ALLOW UP TO EIGHT DETACHED ADUS ON A LOT CONTAINING AN EXISTING MULTIFAMILY RESIDENTIAL DEVELOPMENT.
THE PREVIOUS STANDARD WAS TWO.
UH, IT ALSO ALLOWS CONVERSION OF NON LIVABLE AREAS OF EXISTING MULTIFAMILY PROJECTS INTO ADUS AND CONVERSION OF SOME SPACE WITHIN EXISTING MULTIFAMILY UNITS INTO ADU.
LASTLY, WE'RE GONNA CLARIFY THE APPLICABILITY OF OBJECTIVE DESIGN STANDARDS AND TWO, A DU ADUS THAT MEET THE CRITERIA SPECIFIED IN GOVERNMENT CODE 6 6 3, 2 3.
UH, THESE ARE SOMETIMES CALLED STATE EXEMPT ADUS OR UH, STATE MANDATORY ADUS.
ONE ITEM THAT WE ARE PROPOSING TO CHANGE IN RESPONSE TO INPUT FROM BOTH THE COMMUNITY AS WELL AS CITY STAFF IS THAT WE'RE RECOMMENDING THAT THE SEPARATE UTILITY REQUIREMENT FOR DETACHED ADUS THAT IS CURRENTLY IN PLACE BE MODIFIED TO EXCLUDE REQUIREMENT FOR A SEPARATE SEWER CONNECTION.
UH, PROPERTY OWNERS HAVE EXPRESSED CONCERN REGARDING THE POTENTIALLY SIGNIFICANT COSTS ASSOCIATED WITH INSTALLING THESE SEWER CONNECTIONS.
AND OUR PUBLIC WORKS DEPARTMENT HAS NOTED THAT THESE SEPARATE CONNECTIONS HAVE THE POTENTIAL TO WEAKEN OUR EXISTING SEWER INFRASTRUCTURE, AND OF COURSE, REQUIRE ADDITIONAL TRENCHING IN THE RIGHT OF WAY.
UM, MUCH TO THEIR CHAGRIN, SOMETIMES IN STREETS THAT WERE RECENTLY PAVED.
SO THEY WILL APPRECIATE THIS REQUIREMENT POSSIBLY BEING WAIVED.
THE PLANNING COMMISSION REVIEWED THESE RECOMMENDED CHANGES ON DECEMBER 3RD AND DID ADOPT A RESOLUTION RECOMMENDING THAT THE CITY COUNCIL ADOPT THE PROPOSED MUNICIPAL CODE AMENDMENT.
AND STAFF IS ALSO RECOMMENDING THAT THE CITY COUNCIL RECEIVE THE STAFF REPORT, OPEN PUBLIC HEARING, RECEIVE PUBLIC TESTIMONY, AND INTRODUCE THE ORDINANCE ADOPTING THESE STANDARDS.

UH, HEARING ITEM.THIS IS TO ADOPT A RESOLUTION AMENDING THE MASTER SCHEDULE OF FEES, FINES, AND PENALTIES TO BE PRESENTED BY FINANCE DIRECTOR BAER.
COUNCIL MEMBERS, MEMBERS OF THE PUBLIC AND STAFF.
TONIGHT I'LL BE REVIEWING THE PROPOSED AMENDMENTS TO THE MASTER SCHEDULE OF FEES, FINES, AND PENALTIES THAT WERE DISCUSSED AT THE WORKSHOP ON JANUARY 14TH.
USER FEES ARE DESIGNED TO FUND PROGRAMS AND SERVICES THAT PROVIDE A DIRECT BENEFIT TO THE INDIVIDUAL PAYING THE FEE WITH LITTLE OR NO BENEFIT TO THE BROADER COMMUNITY.
THESE FEES ARE BASED ON A COST RECOVERY MODEL, MEANING THE REVENUE GENERATED CANNOT EXCEED THE ESTIMATED REASONABLE COST OF PROVIDING THE SERVICE.
THE FINANCE AND COMMUNITY SERVICES FEES BEING PROPOSED, UH, WILL TAKE EFFECT ON FEBRUARY 1ST AND THE BUILDING DEVELOPMENT SERVICES AND PUBLIC WORKS FEES ARE PROPOSED TO TAKE EFFECT ON APRIL 1ST, 2025.
THE BUILDING SERVICES DIVISION IN COMMUNITY DEVELOPMENT IS PROPOSING FOUR NEW FEES.
THE FIRST FEE IS OF 200, UH, IS FOR $267.
AND IT COVERS THE INSTALLATION OF UP TO THREE RESIDENTIAL PLUMBING FIXTURES, SUCH AS A KITCHEN SINK OR WATER SOFTENER.
WITH A 50% SURCHARGE FOR EACH ADDITIONAL FIXTURE.
IT IS BASED ON ONE TO TWO INSPECTIONS.
THE SECOND FEE OF $535 COVERS THE INSTALLATION OF COMMERCIAL FIXTURES LIKE DISHWASHERS, LAUNDRY EQUIPMENT, AND BOILERS.
THE AFTER HOURS INSPECTION FEE, WHICH IS BASED ON THE OVERTIME RATE OF $802, APPLIES WHEN DEVELOPERS REQUEST INSPECTIONS OUTSIDE OF REGULAR BUSINESS HOURS.
THE LAST FEE OF $267 IS ASSESSED WHEN WORK HAS PROCEEDED WITHOUT A REQUIRED INSPECTION.
THIS FEE REPRESENTS THE ADDITIONAL TIME NEEDED TO INVESTIGATE AND RESOLVE THE INSPECTION.
BUILDING SERVICES IS ALSO PROPOSING CHANGES TO FOUR EXISTING FEES.
THE TWO EXISTING GEOTECHNICAL REPORT REVIEW FEES ARE BEING COMBINED WITH THE TWO PRECISE GRADING FEES, THEREBY REDUCING COSTS THROUGH PROCESS EFFICIENCIES.
THE ADDRESS CHANGE FEE IS EXPANDED TO INCLUDE NEW ADDRESS ASSIGNMENTS AND REDUCED TO $401 TO UPDATED, UH, STAFF TIME DUE TO UPDATED STAFF TIME ESTIMATES.
AND THE REINSPECTION FEE IS REDUCED BY $201 TO REFLECT THE CURRENT PROCESS DEVELOPMENT SERVICES IS PROPOSING A NEW ENTITLEMENT REVIEW FEE OF $25,000, WHICH COVERS LAND DEVELOPMENT APPLICATION REVIEWS, NOW ASSIGNED TO CONSULTANTS DUE TO STAFFING CHANGES.

TO COMBINE THE BUSINESS LICENSE PROCESSING FEE WITH THE LAND USE CLEARANCE FEE, RESULTING IN A COMBINED FEE OF $267.THE INITIAL DEPOSIT FOR A POST ENTITLEMENT REVIEW UTILIZING ENGINEERING CONSULTING SERVICES IS PROPOSED TO INCREASE FROM $10,702 TO $50,000.
IT'S IMPORTANT TO NOTE THAT THE OVERALL COSTS ARE NOT BEING INCREASED.
THE DEPOSIT IS SIMPLY BEING INGESTED TO REFLECT THE ACTUAL COSTS BEING INCURRED IN PUBLIC WORKS.
THE ENGINEERING DIVISION IS PROPOSING A NEW INITIAL DEPOSIT FOR THE INSPECTION OF MECHANICALLY STABILIZED EARTH WALLS OF 5.5% OF THE ENGINEERING COST ESTIMATE.
THIS NEW FEE ADDRESSES THE INSPECTION REQUIREMENTS FOR NEWER DESIGN DEVELOPMENTS.
THE INITIAL DEPOSIT FOR A SUBDIVISION ENCROACHMENT PERMIT IS PROPOSED TO THE UPDATED TO MATCH THE CURRENT ENGINEERING COST ESTIMATE WORKSHEETS, WHICH REFERENCE 11%.
THE INITIAL DEPOSIT FOR A ROUGH GRADING PERMIT WAS TRANSFERRED FROM BUILDING SERVICE SERVICES TO ENGINEERING.
BECAUSE THEY ISSUE GRADING PERMITS AND PROVIDE INSPECTION OVERSIGHT.
THE DEPOSIT IS PROPOSED TO INCREASE BY $200 BECAUSE A FULLY BURNED HOURLY RATE FOR ENGINEERING IS HIGHER THAN BUILDING SERVICES.
THE COST PER 10,000 CUBIC YARD IS BASED ON ONE HOUR OF STAFF TIME.
SO THIS ADDITIONAL COST IS ALSO PROPOSED TO INCREASE BY $20.
FINANCE IS PROPOSING A NEW ELECTRONIC CHECK FEE, WHICH RANGES FROM 50 CENTS TO A DOLLAR 95 PER TRANSACTION.
THIS FEE WILL BE PASSED THROUGH TO COVER COSTS ASSOCIATED WITH ONLINE ECHECK PAYMENTS.
COMMUNITY SERVICES DEPARTMENT IS PROPOSING A FIVE YEAR FEE ADJUSTMENT FOR FACILITY RENTALS.
KEY CHANGES INCLUDE A 5% ANNUAL INCREASE FROM 2026 TO 2029 TO COUNT FOR INFLATION MARKET TRENDS AND RISING OPERATIONAL COSTS AND RENTAL RATES DETERMINED BY THE CALENDAR YEAR OF THE EVENT RATHER THAN BOOKING DATE.
THESE RATES WERE LAST UPDATED IN APRIL, 2023.
SO THESE INCREASES ARE NECESSARY TO MAINTAIN FINANCIAL SUSTAINABILITY AND COMPETITIVE PRICING.
COMMUNITY DEVELOPMENT RECENTLY IMPLEMENTED NEW BUILDING SOFTWARE THAT REQUIRES PROJECT SIZE AREA THRESHOLDS TO BE ROUNDED TO THE NEAREST HUNDRED.
THEREFORE, STAFF RECOMMENDS UPDATING THE THRESHOLDS IN THE BUILDING PERMIT FEES TABLE NUMBER NINE, WHICH WILL RESULT IN SOME SMALL ASSOCIATED FEE ADJUSTMENTS.

E-BIKE AND MOTORIZED SCOOTER OPERATION WAS ALREADY PROHIBITED IN CITY OWNED OPEN SPACES, TRAILS, AND PARKS.
SO NOW SIDEWALKS JOIN THE LIST OF LOCATIONS.
THE, THIS NEW REGULATION WAS IMPLEMENTED TO ENHANCE PUBLIC SAFETY AND VIOLATIONS OF THE ORDINANCE COULD RESULT IN A HUNDRED DOLLARS FINE FOR THE FIRST DEFENSE, AND UP TO, UH, AS MUCH AS $500 FOR ADDITIONAL OFFENSES.
UH, E-BIKES ARE DEFINED IN THE CALIFORNIA VEHICLE CODE AS BICYCLES WITH AN ELECTRIC MOTOR OF LESS THAN 750 WATTS AND FULLY OPERABLE PEDALS.
UH, I WANT TO STRESS THAT E-BIKES AND ELECTRIC MOTORCYCLES AND OR DIRT BIKES ARE DIFFERENT.
ELECTRIC MOTORCYCLES AND DIRT BIKES TYPICALLY DO NOT HAVE OPERABLE PEDALS AND HAVE SPEED AND POWER LIMITS BEYOND THOSE DEFINED BY E-BIKES.
ELECTRIC MOTORCYCLES AND DIRT BIKES ARE SUBJECT TO THE SAME LAWS AS GASOLINE POWERED ONES.

JUST KIND OF GETTING THE LAY OF THE LAND WHEN IT CAME TO WHAT OUR, UH, FEDERAL EARMARK REQUESTS AND STATE REQUESTS ARE GONNA BE.
SO JUST KIND OF FIGURING OUT WHERE, WHERE WE THEORETICALLY HOPE WE CAN SHAKE DOWN THE FEDERAL GOVERNMENT AND THE STATES FOR THE STATE FOR SOMETHING.

UH, WE, ALTHOUGH WE HAVE NEW ADMINISTRATION IN WASHINGTON, DC UH, ALL I WOULD SAY IS LET'S, UH, LET'S GIVE PEOPLE AT LEAST A LITTLE BIT OF TIME TO SEE WHAT CHANGES HAPPEN.
BUT GOING BACK TO THE WHOLE FIRE DANGER STUFF AND THIS, WE ABATEMENT STUFF, WE'VE ALREADY SEEN THE CRITICISM THAT'S GONE BY WAY OF THE STATE GOVERNMENT HERE IN CALIFORNIA FOR NOT DOING THE PROPER THINGS TO, TO PREVENT THESE WILDFIRES.
