FIRST, WE WANT TO THANK YOU ON BEHALF OF OUR MAYOR AND OUR CITY COUNCIL MEMBERS TODAY, AND WE ASK THAT DURING THIS MEETING, YOU WOULD GUIDE THEIR THOUGHTS AND DISCUSSIONS THROUGHOUT THE REST OF THIS EVENING.

THANK YOU, LORD, THAT AS CITIZENS OF OUR COMMUNITY, OF OUR CITY, WE HAVE THE ABILITY TO BE INVOLVED IN USEFUL WORK AND THE HONOR OF BEARING APPROPRIATE RESPONSIBILITIES.

AND THANK YOU FOR OUR CONSTITUTION AND THE LIBERTY TO LIVE AND WORSHIP YOU ACCORDING TO THE DICTATES OF OUR CONSCIENCE.

IN THE SCRIPTURES, YOU HAVE STATED THAT WE AS CITIZENS OUGHT TO OBEY OUR GOVERNING AUTHORITIES, WHOM YOU HAVE ESTABLISHED TO PROMOTE PEACE, JUSTICE AND THE RULE OF LAW.

THEREFORE, IN LIGHT OF THIS DIRECTIVE AND SCRIPTURE, WE PRAY FOR OUR MAYOR.

WE PRAY FOR THE VARIOUS LEVELS OF CITY OFFICIALS HERE AND IN PARTICULAR FOR OUR ASSEMBLED CITY COUNCIL.

AND WE ASK THAT YOU WOULD GIVE EACH AND EVERY SINGLE ONE OF THEM WISDOM IN THE MIDDLE OF CONFLICTING INTERESTS AND CHANGING ISSUES OF OUR TIME.

WE ASK THAT YOU WOULD GIVE THEM INSIGHT INTO THE WELFARE AND WHAT ARE THE TRUE NEEDS OF OUR CITY, AND A DESIRE FOR THAT WHICH IS RIGHT AND THAT WHICH IS JUST.

AND AGAIN, THAT YOU WOULD GIVE THEM THE ABILITY TO WORK TOGETHER IN UNITY.

AND, LORD, WE ASK THAT YOU WOULD EXTEND PERSONAL PEACE TO ALL OF THEIR LIVES, TO ALL OF THEIR FAMILIES, AND THAT YOU WOULD GRANT ALL PURPOSE IN THEIR DAILY TASK. APPRECIATE IT VERY MUCH. SUBSTANCE ABUSE IS PARTICULARLY DAMAGING TO ONE OF OUR MOST VALUABLE RESOURCES, OUR CHILDREN.

THE THEME OF THIS YEAR'S RED RIBBON WEEK IS LIFE IS A PUZZLE.

SOLVE IT DRUG FREE. THE GOAL IS TO PROMOTE INDIVIDUAL RESPONSIBILITY FOR LIVING A HEALTHY, DRUG FREE LIFESTYLE BUSINESSES, PARENTS, LAW ENFORCEMENT, SCHOOLS AND THE ENTIRE COMMUNITY CAN DEMONSTRATE THEIR COMMITMENT TO A HEALTHY, DRUG FREE LIFESTYLE BY WEARING AND DISPLAYING RED RIBBONS DURING THIS CAMPAIGN.

OUR SHERIFF'S DEPARTMENT IS PROBABLY ONE OF THE BETTER DEPARTMENTS IN CALIFORNIA.

[11. Provide input and comments to City Manager regarding proposed adjustment to residential waste collection routes]

THIS ITEM IS TO PROVIDE INPUT AND COMMENTS TO THE CITY MANAGER REGARDING PROPOSED ADJUSTMENTS TO THE RESIDENTIAL WASTE COLLECTION ROUTES.

AND THIS IS GOING TO BE PRESENTED BY SENIOR MANAGEMENT ANALYST SHAKER.

GOOD EVENING, HONORABLE MAYOR, VICE MAYOR AND COUNCIL MEMBERS. I AM HERE TO PRESENT THE RESIDENTIAL WASTE COLLECTION ROUTE ADJUSTMENT PROPOSED BY WASTE MANAGEMENT THIS EVENING. OH, SORRY.

SO WASTE MANAGEMENT, AS YOU KNOW, STARTED TRASH SERVICES IN THE CITY ON JULY 1ST, 2022. SO AT THAT TIME THEY ASSUMED THE EXISTING COLLECTION ROUTES FROM THE PREVIOUS SOLID WASTE HAULER, REPUBLIC SERVICES OVER THE COURSE OF THE LAST THREE YEARS, WASTE MANAGEMENT HAS IDENTIFIED INEFFICIENCIES WITH THE EXISTING ROUTES AND HAS PROPOSED AN ADJUSTMENT TO RESIDENTIAL ROUTES TO BALANCE THE ROUTES AND PROVIDE MORE EFFICIENT COLLECTION CITYWIDE.

CURRENTLY, THE ROUTES ARE NOT GEOGRAPHICALLY CLUSTERED, WHICH RESULTS IN REDUNDANT VISITS TO IN THE SAME COMMUNITIES AND LONGER SERVICE HOURS.

ADDITIONALLY, THE ROUTES ON MONDAYS AND FRIDAYS ARE THE HEAVIEST SERVICE DAYS, WHICH CAN CAUSE DELAYED PICKUPS.

THOSE ARE SOME OF THE ISSUES, SO SOME OF THE BENEFITS TO THE ROUTE ADJUSTMENT TO OUR CUSTOMERS OVERALL INCLUDE IMPROVED CUSTOMER SERVICE BY PROVIDING MORE PREDICTABLE SERVICE TIMES AND INCREASE RELIABILITY.

THIS IS DONE BY OPTIMIZING ROUTES AND BALANCING PICKUPS ACROSS THE WEEK.

CUSTOMERS SHOULD SEE TRUCKS ARRIVE WITHIN CONSISTENT TIME WINDOWS AND REDUCE THE NUMBER OF MISSED OR DELAYED COLLECTIONS.

ANOTHER BENEFIT WILL BE REDUCING DUPLICATE TRUCK VISITS TO THE SAME AREAS, WHICH WILL CUT DOWN ON THE WEAR AND TEAR ON OUR STREETS.

FUEL, USE TRAVEL TIMES AND MAKE OPERATIONS CLEANER AND MORE EFFICIENT.

SO REDUCING DUPLICATE TRUCK VISITS, WHAT DOES THAT MEAN? SO THE WAY IT'S STRUCTURED RIGHT NOW, FROM MY UNDERSTANDING, IS THERE'S, LET'S SAY ONE COMMUNITY LIKE LOS SERRANOS IS SERVICED ON TWO DAYS A WEEK AND 2 TO 3 DAYS A WEEK TO CERTAIN AREAS LIKE LAKE LOS SERRANOS MOBILE HOME PARK, WHICH I'LL HIGHLIGHT IS ONE OF THE CHANGES.

SO WE'RE MOVING THAT SO THAT THOSE TRUCKS DON'T HAVE TO GO BACK TO THE SAME AREA OF THE, OF THE CITY MULTIPLE TIMES IN THE SAME WEEK.

AND IT CAN BE DONE ON A TIGHTER SERVICE TIME WITHIN A DAY OR TWO.

OKAY. WELL, YOU HAVE A MAP OF IT.

WELL, I DO HAVE MAPS OF WHAT IT'S GOING TO LOOK LIKE WITH THE CHANGE.

OKAY. SO WASTE MANAGEMENT IS HERE.

THEY MIGHT BE ABLE TO SPEAK TO MORE DETAIL AS FAR AS WHAT'S CHANGING WHAT HOW IT IS NOW AND WHAT IT'S CHANGING TO, BECAUSE I'M JUST WONDERING AND JUST LIKE IF WE HAVE THREE BARRELS AND YOU'RE GOING TO NEED A TRUCK TO MAKE THREE DIFFERENT TRIPS.

SO HOW DOES THIS RELATE TO THE SAME STREET BUT TO THE SAME NEIGHBORHOOD, I GUESS, OR TO THE SAME AREA OF THE CITY, IF THAT MAKES SENSE.

SO LIKE THE SOUTHERN PARTS.

OKAY. WELL, MAYBE WE CAN CIRCLE.

WE'LL LOOK AT THE MAPS GOING FORWARD. NO WORRIES.

SO AS MENTIONED, MONDAYS AND FRIDAYS ARE CURRENTLY THE HIGHEST VOLUME DAYS.

AND MONDAYS TYPICALLY HAVE THE HIGHEST NUMBER OF DRIVER CALLOUTS WHICH, WHICH CAN RESULT IN LONGER SERVICE HOURS.

AND REBALANCING THE ROUTES WILL EASE PRESSURE ON MONDAYS.

AND ADJUSTMENTS TO FRIDAYS ARE BEING MADE TO ACCOMMODATE FOR FUTURE DEVELOPMENT, PARTICULARLY IN THE SOUTHERN PART OF THE CITY.

SO THE TOTAL NUMBER OF CURRENT RESIDENTIAL CUSTOMERS IS ABOUT 20,122 AND ABOUT 24%, OR 4879 CUSTOMERS, WILL HAVE A NEW SERVICE DAY.

THE SERVICE DAY CHANGES WILL BE EFFECTIVE THE FIRST WEEK OF DECEMBER.

ON DECEMBER 1ST, AND WASTE MANAGEMENT HAS COMMITTED TO PROVIDING PICKUPS FOR THREE WEEKS FOLLOWING THE SERVICE DAY CHANGE FOR CUSTOMERS WHO FORGET TO SET OUT THEIR CARTS OUT DURING THE FIRST FEW WEEKS FOLLOWING THE CHANGE. SO I WANTED TO HIGHLIGHT A FEW KEY

NEIGHBORHOOD CHANGES, BUT PLEASE NOTE THAT THIS DOES NOT INCLUDE ALL CHANGES. CARBON CANYON IS MOVING FROM WEDNESDAY TO MONDAY, EXCEPT FOR SLEEPY HOLLOW AREA, WHICH WILL STAY ON WEDNESDAYS.

LAKE LOS SERRANOS MOBILE HOME PARK IS MOVING FROM TUESDAY TO WEDNESDAY.

FAIRFIELD RANCH IS MOVING FROM FRIDAY TO THURSDAY, AND AS YOU MAY KNOW OR YOU MAY HAVE HEARD, THIS DID IMPACT THEIR CURRENT STREET SWEEPING DAY, WHICH WAS ON THURSDAY.

AND WASTE MANAGEMENT HAS WORKED WITH THE PROPERTY MANAGEMENT COMPANY AND CONFIRMED THAT FAIRFIELD RANCH WILL SHIFT ITS STREET SWEEPING DAY FROM THURSDAY TO FRIDAY TO ACCOMMODATE THE NEW TRASH DAY.

ADDITIONALLY, WASTE MANAGEMENT WILL COVER THE COST OF THE NEW STREET SWEEPING SIGNAGE IN THAT COMMUNITY. SO NOW WE'RE GOING TO GET INTO THE MAPS.

SO THE MONDAY THIS IS A MAP OF THE NEW MONDAY SERVICE AREA.

SO CURRENTLY MONDAY HAS 4421 STOPS.

AS I SAID IT'S ONE OF THE HEAVIER DAYS.

AND THIS WILL BE REDUCED TO 3505 STOPS.

SO WHAT ACCOUNTS FOR THAT MANY.

THERE ARE 900 AND SOME ODD STOPS THAT ARE BEING REDUCED.

SO A LOT OF THE SHIFT IS GOING FROM MONDAY IS GOING TO BE SORRY, I DON'T RECALL OFF THE TOP OF MY HEAD OF THE BIG NEIGHBORHOOD THAT'S MOVING.

I CAN'T ANSWER THAT JUST TO BALANCE IT OUT DURING THE WEEK.

RIGHT. SO IT'S LIKE TO BE HAPPY ON MONDAY AND FRIDAY.

IT'S GOING TO BE EVEN ACROSS ACROSS THE BOARD.

YES. AND THAT IS THE GOAL.

WE HAVE WASTE MANAGEMENT HERE. THEY ARE HERE WHICH SHOULD THEY MIGHT BE ABLE TO SPEAK TO IF YOU WANTED TO ASK. NOW MAYOR AND COUNCIL, AS YOU MAY KNOW, SUSAN IS THE STAFF REPRESENTATIVE FOR INTERACTING WITH WASTE MANAGEMENT.

I ASKED HER TO GIVE THE OVERALL PICTURE OF WHAT'S GOING ON, BUT WE DO HAVE WASTE MANAGEMENT HERE, AND I'D LIKE TO DELVE INTO THOSE SPECIFICS.

MAYBE BY GOING BACK TO KEY SLIDES AND WALKING THROUGH IT.

THERE ARE A LOT OF MOVING PARTS, AND THAT'S THE REASON WE BROUGHT IT BEFORE THE COUNCIL. WE'VE LOOKED AT IT, BUT WE ALWAYS WANT TO HEAR YOUR PERSPECTIVE.

AND WITH ALL OF THIS, THESE ISSUES THAT WERE COMING UP, IT WAS DETERMINED BY WASTE MANAGEMENT THAT THEY NEEDED TO KIND OF TAKE A STEP BACK, TAKE ANOTHER LOOK TO HELP FACILITATE MORE EFFECTIVE PICKUP OF THE TRASH TO TRY AND MINIMIZE THAT THEY HAVE GONE THROUGH THE LOGISTICS.

NOT ONLY DO THEY HAVE THE TRASH TO CONCERN THEMSELVES WITH, BUT WE HAVE STREET SWEEPING, AND STREET SWEEPING HAS ITS DEFINED DAYS.

SO WHAT THEY HAVE DONE IS PUT FORTH A LOT OF EFFORT TO TRY AND MINIMIZE THE NUMBER OF ROUTE CHANGES. I THINK IT'S ONLY LIMITED TO TWO COUNCIL DISTRICTS, AND WE CAN GET THEM TO CONFIRM THAT FOR US.

BUT TO CHANGE THE DISTRICT OR CHANGE THE ROUTING ENOUGH TO WHERE WE CAN NOW GET MORE COHESIVE PICKUP AND LESS TRIPS ON THE ROAD.

THE PROPOSED FEE FOR THIS VIOLATION IS $48, AND THE BACKGROUND HERE IS IS THAT FREQUENTLY CODE ENFORCEMENT GETS CALLS AND SAYS ON THE WEEKEND, MY NEIGHBORS WERE PARKING IN THE YARD AND WE HAVE NO WAY OF ENFORCING THAT AFTER THE FACT.

SO THIS WILL ALLOW THE POLICE DEPARTMENT TO DO ENFORCEMENT IF APPROPRIATE. IT'LL BE AT THEIR DISCRETION, BUT THEY'LL HAVE THE ABILITY TO TO CITE FOR PARKING ON THE YARD.

THE LAST CODE SECTION FOR PARKING THAT WE'RE DISCUSSING IS RELATED TO SECTION 10.0, 0.2002. PARKING AND ACCESS AREAS ADJACENT TO DESIGNATED DISABLED PARKING SPACES.

THESE ARE OFTENTIMES THE HASH MARK AREAS RIGHT NEXT TO THE PARKING SPACE, AND PEOPLE HAVE A TENDENCY TO SOMETIMES PARK THERE. OUR CODE SPECIFICALLY NOW ONLY ADDRESSES THE DISABLED PARKING SPOT ITSELF.

SO THIS WILL ALSO MAKE IT ALSO A VIOLATION OF PARKING THE HASH MARK NEXT TO IT, THE UNLOADING AND LOADING AREA NEXT TO THAT PARKING SPACE.

RELATED TO THOSE. SO WE ARE PROPOSING THAT WE ACTUALLY DESIGNATE THOSE WITHIN THE STATE OR THE POLICE DEPARTMENT CAN THEN ENFORCE THE VEHICLE CODE RELATED TO THOSE PARKING SPACES.

SO IF PEOPLE ARE PARKED THERE AND NOT CHARGING, THEN IT IS A VIOLATION. THEY CAN BE CITED FOR THAT, RIGHT? ROUGHLY HOW MANY SPOTS ARE THERE FOR EV? I BELIEVE THERE'S AROUND SEVEN HERE AT CITY HALL AND CURRENTLY THREE OVER.

IT'S BECOME A REQUIREMENT OF THAT ACTION, THE EMERGENCY ACTION TO BRING TO THE COUNCIL UPDATES AND AND TO HAVE THE COUNCIL BY 4/5 VOTE.

CONTINUE THE EMERGENCY DECLARATION.

AND WHAT WE ARE HAVE EXPERIENCED SINCE OUR LAST MEETING IS THAT, OF COURSE, ALL OF OUR STAFF ARE BACK IN CITY HALL.

WE CONTINUE TO BE SERVING THE PUBLIC THROUGH OUR CUSTOMER SERVICE CENTER, AWAY FROM OUR MAIN COUNTERS, WHILE WE REPAIR THE ELEVATOR.

AND TO A CERTAIN EXTENT, THE COUNCIL GAVE THE CITY MANAGER AND STAFF THE FLEXIBILITY TO MOVE AS QUICKLY AS POSSIBLE, WHICH MEANT THERE WERE TIMES WHERE WE WERE AUTHORIZING THE WORK PRIOR TO THE INSURANCE COMPANY CONFIRMING THAT THEY WERE ON BOARD WITH THE EXPENSES.

I'M HAPPY TO REPORT THAT OF THE $3.93 MILLION, THAT OF WORK THAT HAS OCCURRED, 3.67 OF IT HAS BEEN PAID BY THE INSURANCE COMPANY. SO SINCE OUR LAST MEETING, OVER $1 MILLION OF WORK THAT WAS UNDER REVIEW HAS NOW BEEN PAID. SO WE HAVE FAR LESS WORK THAT'S STILL BEING REVIEWED.

SO OUR ESTIMATE IS STILL THAT THE TOTAL PROJECT WILL BE ABOUT $4.5 MILLION.

BUT WE'RE A LOT CLOSER TO THE COMPLETION OF THIS PROCESS THAN WE WERE EVEN TWO WEEKS AGO.

SINCE 2006. THIS AGREEMENT IS A TAX SHARING RELATIONSHIP WHERE THE SALES THAT ARE GENERATED AND THAT OCCUR AT THIS LOCATION FOR MULTIPLE SITES FOR THE BUSINESS, ALLOWS THAT BUSINESS TO SHARE IN THE TAXES THAT ARE GENERATED.

IN ESSENCE, 50% UP TO, LET'S SEE, UP TO $359,000.

THE BUSINESS WILL BE ABLE TO SHARE IN THE TAX AGREEMENT WITH THE CITY.

SO FOR EVERY DOLLAR THAT THIS CORPORATION GENERATES IN TAX DOLLARS, 50, 50% IS REBATED TO THEM UP TO $359,000.

CITY STAFF WORKED WITH WILLDAN FINANCIAL SERVICES TO COMPLETE THIS UPDATE, ANALYZING SERVICE COSTS AND RECOMMENDING ADJUSTMENTS TO ENSURE THE FEES REMAIN FAIR AND DEFENSIBLE.

TONIGHT, I'LL PROVIDE A BRIEF OVERVIEW OF HOW USER FEES ARE CALCULATED, AS WELL AS THE NEW AND INCREASED FEES BEING PROPOSED.

USER FEES ARE ADOPTED TO FUND PROGRAMS AND SERVICES THAT PROVIDE A DIRECT BENEFIT TO THE INDIVIDUAL PAYING THE FEE WITH LIMITED OR NO DIRECT BENEFIT TO THE COMMUNITY.

THE CITY'S USER FEES ARE BASED ON A COST RECOVERY CONCEPT, MEANING THAT THE AMOUNT OF REVENUE GENERATED FROM THE FEES MAY NOT EXCEED THE ESTIMATED REASONABLE COST OF PROVIDING THE SERVICE.

THE USER FEES ARE CALCULATED BY MULTIPLYING THE FULLY BURDENED HOURLY DEPARTMENT OR DIVISION RATES BY THE AVERAGE TIME SPENT TO PROVIDE THE SERVICE DIRECTLY RELATED TO THE USER FEE. FULLY BURDENED HOURLY RATES INCLUDE SALARY AND BENEFIT COSTS, PLUS ALL APPLICABLE OVERHEAD AMOUNTS FOR THE BLENDED GROUP, WHICH IS EITHER THE DEPARTMENT OR DIVISION.

EVERY YEAR, STAFF EVALUATES THE TIME SPENT ON VARIOUS SERVICES IN THEIR DEPARTMENT AND ADJUST THE TIME DATA AS NEEDED BASED ON THE AVERAGE TIME SPENT ON EACH SERVICE.

STAFF IS PROPOSING THAT THESE REVISED FEES WILL BECOME EFFECTIVE JANUARY 1ST, 2026. THIS YEAR, A TOTAL OF 12 NEW FEES HAVE BEEN INTRODUCED TO BETTER REFLECT THE SERVICES PROVIDED BY THE CITY AND ENSURE COST RECOVERY.

SINCE WE HAVE ALREADY DISCUSSED THEM AT THE WORKSHOP, I'LL BRIEFLY SHOW THEM FOR THE AUDIENCE.

HERE WE HAVE THE NEW FEES FOR BUILDING SERVICES, THE CITY CLERK'S OFFICE, CODE ENFORCEMENT AND COMMUNITY SERVICES.

SO THIS IS A DEPOSIT THAT WOULD BE PAID ESSENTIALLY PAYS FOR STAFF TIME TO PROCESS THE PERMIT AND FOR AN ARBORIST.

CITY ARBORIST TO REVIEW THE PROPOSED REMOVAL OF JUST THOSE PROTECTED TREES.

SO THOSE ARE THE VERY LARGE, LIKE THE HERITAGE TREES WE CALL THEM.

THE INCREASE FOR THESE FOR DEVELOPMENT SERVICE FEES RANGE FROM $408 TO 416.

AND THESE FOR DEVELOPMENT SERVICE FEES ARE INCREASING BY AMOUNTS RANGING FROM 410 TO 944. THE INCREASES FOR THE SIX FEES IN UTILITY BILLING RANGE FROM $15 TO AND 86. AND LASTLY, WE HAVE SIX WATER METER INSTALLATION FEES INCREASING BY AMOUNTS RANGING FROM $39 TO 170.

SO THE RECOMMENDATION BEFORE YOU TONIGHT IS TO CONDUCT A PUBLIC HEARING AND ADOPT THE RESOLUTION APPROVING THE PROPOSED FEES AND FEE REVISIONS WITH AN EFFECTIVE DATE OF JANUARY 1ST, 2026. AND THAT CONCLUDES MY PRESENTATION.

OCTOBER 14TH. WE HELD A WORKSHOP TO DISCUSS IN DETAIL THE DEVELOPMENT IMPACT FEE NEXUS STUDY UPDATE, WHICH LOOKS AT HOW WE FUND THE PUBLIC FACILITIES NEEDED TO SUPPORT GROWTH THROUGH 2045. THE PURPOSE OF THIS STUDY IS TO ENSURE THAT NEW DEVELOPMENT IN CHINO HILLS PAYS ITS FAIR SHARE OF THE FACILITIES AND INFRASTRUCTURE REQUIRED TO SUPPORT IT.

THIS. THIS PROTECTS OUR EXISTING RESIDENTS FROM SHOULDERING THE COST OF GROWTH.

THE STUDY THAT WAS PREPARED BY WILLDAN FINANCIAL SERVICES EVALUATES FOUR MAJOR CATEGORIES OF FACILITIES GENERAL CITY FACILITIES, TRAFFIC FACILITIES, PARKS AND RECREATION, AND QUIMBY AND LIU AND FIRE FACILITIES TO CALCULATE THE FEES. THE STUDY USES UPDATED GROWTH FORECASTS THROUGH 2045.

OVER THIS PERIOD, WE EXPECT ROUGHLY 13,600 NEW RESIDENTS, ALONG WITH ADDITIONAL COMMERCIAL AND EMPLOYMENT GROWTH.

THIS TABLE SHOWS THE INTENSITY OF LAND USE REPRESENTED IN TERMS OF PEOPLE.

BASED ON THIS PROJECTED GROWTH, THE STUDY IDENTIFIES THE CITY'S FACILITY NEEDS AND DETERMINES THE MAXIMUM FEES THAT ARE LEGALLY DEFENSIBLE UNDER STATE LAW.

THE STUDY USES TWO COMMON METHODS OF DETERMINING NEW DEVELOPMENTS FAIR SHARE OF PLANNED FACILITIES COST, THE PLANNED FACILITIES METHOD,

THE PLANNED FACILITIES METHOD LOOKS AT THE COST OF NEW FACILITIES BEING PLANNED AND DIVIDES IT BY THE DEMAND FOR NEW DEVELOPMENT.

THE EXISTING INVENTORY METHOD LOOKS AT THE FACILITIES THE CITY ALREADY HAS AND DIVIDES THEIR VALUE BY THE DEMAND FROM EXISTING DEVELOPMENT.

THE NEW DEVELOPMENT THEN PAYS ENOUGH TO MAINTAIN THE SAME LEVEL OF SERVICE THAT EXISTING RESIDENTS CURRENTLY ENJOY.

BECAUSE OUR CURRENT FEES ARE BASED ON AN AVERAGE COST PER DWELLING UNIT.

WITH THIS UPDATE, RESIDENTIAL FEES ARE CHANGING TO PER SQUARE FOOT BASIS IN ACCORDANCE WITH ASSEMBLY BILL 602.

THE PROJECTS ARE BASED ON THE CITY'S APRIL 2024 TRAFFIC STUDY, WHICH WAS CONDUCTED AS PART OF THE GENERAL PLAN UPDATE.

WE JUST WANTED TO PAUSE ON THE FIRE FACILITIES FEE BECAUSE THERE WAS DISCUSSION AND QUESTIONS FROM THE COUNCIL DURING OUR WORKSHOP RELATED TO THE FIRE.

THIS NEW FIRE FACILITIES FEE.

AND I THINK IT WAS IMPORTANT FOR US TO POINT OUT THAT WE ARE CURRENTLY CONSTRUCTING.

AND BY WE I MEAN THE FIRE DISTRICT IS CURRENTLY CONSTRUCTING A NEW FIRE STATION 68.

A PART OF THAT AGREEMENT THAT BROUGHT THAT STATION INCLUDED A CONTRIBUTION FROM THE CITY OF CHINO HILLS OF $8 MILLION TOWARD THE CONSTRUCTION OF THAT FACILITY.

WHEN WE NEGOTIATED THAT AGREEMENT TO MAKE THAT PAYMENT.

THERE WAS A COMPONENT OF LAND THAT WAS CONTRIBUTED BY THE CITY.

THERE WAS ALSO A PIECE OF LAND THAT THE CITY RECEIVED.

BUT ONE OF THE OTHER PROVISIONS IN THAT AGREEMENT WAS TO BRING TO THE CITY COUNCIL A SPECIFIC DEVELOPMENT IMPACT FEE FOR FIRE FACILITIES, BECAUSE IN THE PAST, THE COUNCIL HAS ELECTED TO USE OTHER FUNDS TO SUPPORT FIRE ACTIVITY.

AND SO RATHER THAN USING EITHER CFDS OR GENERAL GENERAL CITY FACILITY FEES THAT COULD GO TO OTHER PURPOSES IN THE CITY, WE WANTED TO BRING FOR YOUR CONSIDERATION THIS FIRE DIFF OR FIRE DEVELOPMENT IMPACT FEE AS A VERY SPECIFIC ASSESSMENT TO NEW DEVELOPMENT FOR FIRE PURPOSES.

AND SO WHAT THIS FEE WOULD PAY FOR ARE THE VARIOUS EQUIPMENT AND POTENTIAL STRUCTURES LISTED HERE, BUT IT ALSO RECOVERS SOME OF THE $8 MILLION THAT WAS APPROPRIATED FOR THE FIRE STATION 68. SO JUST TO PUT IT INTO CONTEXT FOR THE RESIDENTS, AND I KNOW THE COUNCIL HAD QUESTIONS AND DISCUSSION ABOUT THIS, BUT SINCE THAT'S A NEW FEE, WE JUST WANTED TO TAKE A PAUSE TO POINT OUT THAT SPECIFIC FEE AS WE RUN THROUGH EVERYTHING MORE QUICKLY THAT HAPPENED AT THE AT THE WORKSHOP. BUT I THINK THE DISTINCTION THAT COUNCILMEMBER MARQUEZ AND THE COUNCIL HAVE MADE OVER THE YEARS IS THE CONTRIBUTION THAT THE CITY HAS MADE, HAS EXCEEDED THAT ORIGINAL COLLECTION FROM THE FIRE DEPARTMENT.

SO BASED ON OUR INTERPRETATION OF THE LAFCO DOCUMENTS, WE HAVE MET THOSE REQUIREMENTS.

THE COUNCIL MAY ELECT TO CONTINUE TO SUPPORT FIRE ACTIVITIES, BUT THIS IS A NEW MECHANISM TO PAY FOR THAT.

WITH ALL THAT IN MIND, I'VE LISTED SOME POTENTIAL POLICY CONSIDERATIONS RELATED TO THE PARKS AND RECREATION FACILITIES FEE AND THE QUIMBY AND LIEU FEES, AND I'LL TURN IT OVER TO COMMUNITY DEVELOPMENT DIRECTOR NICK TO GO INTO MORE DETAIL. SO THE COUNCIL HAS RECEIVED SEVERAL LETTERS FROM BUILDING INDUSTRY ASSOCIATION OF SOUTHERN CALIFORNIA, AS WELL AS LENNAR AND WARMINGTON HOMES, REQUESTING A COUPLE OF DIFFERENT ITEMS. ONE WOULD BE TO GRANDFATHER ALL PROJECTS WHERE THERE'S A CURRENT APPROVED TENTATIVE MAP. AS LONG AS THAT TENTATIVE MAP IS FINALIZED BY NOVEMBER 1ST OF 2028.

THE SECOND REQUEST WAS TO PHASE IN THE PARK AND QUIMBY IN LIEU FEES OVER A FOUR YEAR PERIOD. SO THE FIRST YEAR WOULD BE 25% OF THE INCREASE, THEN 50, THEN 75 WORKING UP TO THE 100% OF THE FEE IN JANUARY FOR IMPLEMENTED JANUARY 1ST, 2029. SO SOME THINGS TO CONSIDER WHEN, WHEN LOOKING AT IS THAT THE CITY DOES HAVE 44 PARKS. THE QUIMBY FEES CAN BE USED TO BUILD NEW PARKS.

THEY CAN ALSO BE USED FOR EXTENSIVE REHABILITATION OF PARKS THAT SERVE THE SUBDIVISIONS, WHERE THE FEE IS PAID.

AND A GOOD CHUNK OF HER NEW DEVELOPMENT IS IN AREAS WHERE THERE IS VACANT LAND THAT'S BEEN ZONED FOR DEVELOPMENT SINCE BEFORE INCORPORATION.

BUT IT JUST HAS NEVER DEVELOPED.

BUT THERE'S OTHER ADJACENT PROPERTIES THAT ARE DEVELOPED AND THERE ARE PARKS ADJACENT TO

THEM. SO THERE ARE EXPENSES THAT THE CITY IS GOING TO HAVE WHEN IT COMES TO MAINTAINING OUR PARKS GOING INTO THE FUTURE.

ADDITIONALLY, THE STUDY IS BASED UPON THE EXISTING STANDARD.

SO AS WE ADD POPULATION TO THE CITY, THE WAY THE FEE IS CALCULATED IS THAT WE'LL BE ABLE TO MAINTAIN THE SAME LEVEL OF PARK, AMENITY AND PARK SERVICE TO THE NEW RESIDENTS AS THE EXISTING RESIDENTS ENJOY.

AND SO THAT ACCOUNTS FOR A CHUNK OF THE FEE BECAUSE IT'S BASED UPON CURRENT LAND VALUES AND CURRENT CONSTRUCTION COSTS.

SO GRANDFATHERING THE PROJECTS THAT HAVE AN APPROVED TENTATIVE MAP.

THOSE ARE THOSE ARE REAL COSTS, RIGHT? THAT'S LOST REVENUE TO THE CITY.

THAT WOULD NOT BE GOING INTO THE PROGRAM TO PAY FOR THOSE FUTURE PARK IMPROVEMENTS UNTIL SUCH TIME AS THOSE PIECES ARE BUILT OUT.

AND THEN THE PHASING AGAIN, PHASING GIVES US A PORTION OF THE REVENUE.

BUT AS THOSE PROJECTS ARE BUILT, WE'RE WE'RE STILL LOSING THE FULL AMOUNT OF REVENUE. AND SO THOSE DOLLARS THAT ARE NEEDED TO BUILD THOSE FUTURE FACILITIES HAVE TO COME FROM OTHER SOURCES. THEY WOULDN'T BE ABLE TO COME FROM THE PARK FUND, BUT THEY MIGHT HAVE TO COME FROM CFDS OR FROM FROM THE GENERAL FUND TO TO OFFSET THAT.

OKAY. JUST RELATED TO WHAT HE SAID, I KNOW YOU HAVE A QUESTION, BUT JUST WITH WHAT NICK SAYING RIGHT NOW. SO I WAS WONDERING, LIKE, SO SPECIFICALLY THOUGH, WHEN YOU'RE TALKING ABOUT LIKE THE GRANDFATHERING, BUT WHAT WOULD THE SPECIFICALLY LIKE, WHAT WOULD THE FINANCIAL IMPACT BE WITH THE CURRENT UNITS THAT WOULD QUALIFY FOR GRANDFATHERING? ASSUMING THAT THEY ALL GET FINALIZED BY THE PROPOSED NOVEMBER 1ST, 2028 DEADLINE, WE'D BE LOOKING AT BETWEEN 8 AND $9 MILLION THAT WE WOULD BE GIVING UP IN FEE COLLECTION IF WE WERE TO JUST CONTINUE COLLECTING THE CURRENT FEE.

VERSUS THE NEW FEE. OKAY.

WE WOULD ASK THE COUNCIL, RESPECTFULLY TO EXERCISE ITS LOCAL CONTROL.

AS YOU KNOW, THE RESALE MARKET IS PRETTY LOCKED UP.

PEOPLE STAY IN THEIR HOMES WITH THEIR 2.5% OR 3% MORTGAGE RATE.

SO THERE'S THE OPPORTUNITY TO BUY A NEW HOME IS GENERALLY AVAILABLE TO THOSE FIRST TIME HOME BUYERS, BUT THEY CAN'T AFFORD IT.

AND ONE THING THAT WE'RE DOING IS BUYING DOWN MORTGAGE RATES TO EXTREME LEVELS, DOWN TO EVEN IN SOME CASES, A 3.99% MORTGAGE.

AND THOSE COMES THAT COMES WITH EXTREME COSTS.

AND I CAN SPEAK FOR THE BUILDER COMMUNITY THAT WE'RE FACING MUCH HARDSHIP WITH HAVING TO DO THAT TO, TO GET PEOPLE INTO HOMES.

SO EVERY DOLLAR COUNTS IS KIND OF THE POINT THAT I'M MAKING THAT WE NEED THE ENTIRE COST STACK TO COME DOWN SO PEOPLE CAN AFFORD A HOME IN THE INLAND EMPIRE.

SO THIS FEE INCREASE, PARTICULARLY THE PARKS FEE, IS A VERY DRAMATIC INCREASE.

AND WE DO RECOGNIZE THAT THE CITY DOES NEED TO HAVE QUALITY PARKS.

WE RECOGNIZE THAT THAT'S IMPORTANT FOR US TO AS A BUILDER.

AND I THINK THIS IS WHERE WE NEED TO FIND THE RIGHT BALANCE.

AND THAT'S WHY I THINK THE PROPOSAL THAT WE'VE PUT FORTH MAKES A LOT OF SENSE FOR PROJECTS THAT HAVE THEIR APPROVED MAPS.

THEY HAVE THEIR CAPITAL SECURED.

THEY HAVE THEIR BUSINESS PLANS SET UP.

IT IS A VERY BIG HARDSHIP TO ACCEPT A FEE OF 11,000 PLUS MORE PER HOME, AND ALSO PHASING IN THE FEE INCREASE OVER TIME CAN HELP REDUCE THAT BLUNT OF THE FEE INCREASE. I'D EXPRESSED CONCERN REGARDING EMERGENCY EGRESS OUT OF CARBON CANYON IN THE EVENT OF A FIRE, AND THERE WAS GOING TO BE SOME ADDITIONAL EVALUATION OF EMERGENCY EXIT ROUTES, AND ESPECIALLY IN LIEU OF THE ADDITIONAL HOUSING BEING BUILT IN CARBON CANYON, ARE THE EXISTING TWO ROUTES EMERGENCY EXIT ROUTES OUT OF CARBON CANYON GOING TO BE SUFFICIENT FOR ALL THE ADDITIONAL RESIDENTS? ONE OTHER ITEM THAT CAME UP DURING OUR LAST NEIGHBORHOOD WATCH MEETING, ONE OF OUR RESIDENTS DID CHECK OUT THE GATES AT THE TWO EMERGENCY EXIT ROUTES, AND THEY DISCOVERED THAT THE GATES AT THE EXIT TOWARD VILANO SEEM TO BE IN POOR REPAIR.

AND THE QUESTION IS, WOULD ANY WORK BE DONE ON THOSE GATES? AND THERE'S ALSO TWO GATES THAT YOU HAVE TO GO THROUGH TO GET THROUGH TO VILANO.

NO. AND IS THERE GOING TO BE SUFFICIENT TIME AND RESOURCES TO OPEN BOTH GATES SO THAT PEOPLE CAN GET OUT? SO THAT'S THE FIRST FOLLOW UP ITEM.

THE SECOND ONE ALSO CAME UP DURING OUR LAST NEIGHBORHOOD WATCH MEETING, WHICH IS THAT IN SUMMIT RANCH, WE HAVE WATER TANKS, WHICH ARE USED TO GENERATE EXTRA WATER PRESSURE BECAUSE WE'RE UP ON A HILL.

AND OUR QUESTION TO THE CITY IS THAT IN THE LOSS OF POWER AND IN AN EMERGENCY SITUATION, LIKE A FIRE, WILL WE HAVE SUFFICIENT WATER PRESSURE IF THAT PUMPING STATION LOST POWER? SO THOSE ARE THE QUESTIONS WE HAVE.

IS IT APPROPRIATE TO HAVE STAFF ANSWER THAT? DANIEL CAN ANSWER THAT. WE'VE ASKED THAT QUESTION BEFORE.

YEAH. YEAH. YES, WE DO HAVE REDUNDANCY AT OUR WATER FACILITIES.

WE JUST RECENTLY INSTALLED A SYSTEM.

WE DID HAVE AN AREA THAT WAS VULNERABLE TO POWER OUTAGES, BUT THAT'S BEEN ADDRESSED.

WITHIN THE LAST COUPLE OF MONTHS, THAT WAS CANNON LANE, RIGHT? CORRECT. YES. BUT EVERYTHING IN THE CANYON AND THROUGHOUT THE CITY DOES HAVE EITHER PERMANENT BACKUP BATTERY SYSTEMS OR THE ABILITY TO PROVIDE PORTABLE POWER BACKUP IF NEEDED. OKAY. SO THAT WOULD TAKE CARE OF OUR PUMPING STATION IN SUMMIT RANCH.

I DON'T KNOW THE SPECIFIC AREAS, BUT YES, EVERYTHING IN WITHIN THE CARBON CANYON AREA THROUGHOUT THE CITY WILL HAVE BATTERY BACKUP POWER TO BE ABLE TO PROVIDE YOU WITH ENOUGH PRESSURE.

SHOULD WE LOSE POWER FOR AN EXTENDED PERIOD OF TIME? OKAY. MR. MAYOR, ONE FOLLOW UP QUESTION.

AND SO ONE OF THE THINGS THAT WE'VE DONE, I KNOW OUR ASSISTANT CITY MANAGER WHO'S OVER EMERGENCY PREPAREDNESS, ACTUALLY HAS DRIVEN OUT TO LOOK AT SOME OF THE GATES AS WELL. SO I GUESS THE ANSWER IS WE'RE GOING TO BRING THAT BACK TO THE COUNCIL TO LOOK AT VARIOUS ASPECTS OF IT, INCLUDING SOME OF THE RIGHTS OF THE PRIVATE COMMUNITIES WHEN IT COMES TO ACCESS AND THROUGH THEIR GATE.

SO WE WANT TO LAY THAT ALL OUT FOR THE CITY.

HE WAS A DEPUTY AT THE RANCHO CUCAMONGA STATION AT THE TIME OF HIS DEATH, AND SERVED THE COMMUNITY WITH PRIDE AND PROFESSIONALISM.

I UNDERSTAND HE NEVER DID SERVE HERE AT CHINO HILLS AS SOMETHING WE WERE TOLD.

IS THAT CORRECT? YEAH.
